KLG:ar <br />5/1/78 <br /> <br />RESOLUTION NO. 78-52 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AUTHORIZING EXPENDITURES OF MORE <br />THAN TWO THOUSAND DOLLARS FOR MATERIALS, SUPPLIES~ <br />AND EQUIPb~NT WITHOUT ADVERTISING FOR BIDS, <br />AND DECLARING THE SAME TO BE OF URGENT NECESSITY <br />FOR THE PRESERVATION OF LIFE, HEALTH, AND PROPERTY, <br />AND DECLARING THE FACTS CONSTITUTING SUCH URGENCY. <br /> <br /> WHEREAS, this Council finds and determines that <br />trash and garbage are not being collected within the geograph- <br />ical limits of the city for the reason that the employees <br />of the city's contractor are presently on strike, which strike <br />is now commencing its third week; that prospects for an early <br />settlement of said strike appear to be slight at the present <br />time; that the accumulation of garbage and trash is causing <br />nuisances by breeding flies, creating offensive odors, caus- <br />ing litter, endangering thereby the public health, safety <br />and welfare; and <br /> <br /> WHEREAS, it may be necessary for city forces to <br />be involved in whatever actions may be necessary to reduce <br />and eliminate such nuisances, and such actions may require <br />the purchase or rental of equipment, materials and supplies <br />to aid in disposing of said garbage and trash; and <br /> <br /> WHEREAS, because of the urgency of said problem, <br />time will not permit contracts therefor to be let by adver- <br />tising for bids, and this Council deems the contracts neces- <br />sary therefor to be of urgent necessity for preservation of <br />life, health, and property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA, AS FOLLOWS: <br /> <br /> 1. That the foregoing recitals, and each of them, <br />are true and correct, and this Council hereby so finds and <br />determines. <br /> <br /> 2. This Council hereby authorizes the City Manager <br />to execute such and so many of said contracts in excess of <br />Two Thousand Dollars ($2,000.00), subject to a maximum cumula- <br />tive expenditure of Twenty Thousand Dollars ($20,000.00), as <br />may be necessary to obtain the materials, supplies, and equip- <br />ment necessary to enable the city to abate said nuisances, <br />all without advertising for bids. <br /> <br /> ADOPTED this 1st day of <br />1978 by the following vote: <br /> <br />May , <br /> <br />AYES: <br /> <br />COUNCILMEN: Ward, Garthe, Brandt, Yamamoto, Bricken <br /> <br /> NOES: COUNCILMEN: Ortiz <br /> ABSENT: COUNCILMEN: Evans ~~~ff_~ff~/ <br /> Attest: <br /> <br /> FLO~NCEI, MALOh~ <br /> MAYOR <br /> <br />KEITH L.
