KLG:ar <br />5/31/78 <br /> <br />RESOLUTION NO. 78-71 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AMENDING RESOLUTION NO. 77-79 <br />TO FIX A SURCHARGE UPON WATER RATES AND STANDBY <br />SERVICE CHARGES IN A CERTAIN AREA OF THE CITY <br /> OF SANTA ANA <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SANTAANA: <br /> <br /> 1. That Resolution No. 77-79 of this Council, adopted <br />on July 18, 1977, is hereby amended by adding thereto the <br />following section 5: <br /> <br /> Section 5. That a surcharge of One <br />Dollar ($1.00) per month is to be levied <br />and collected for each water service towhichwater is <br />supplied by the city, or to which a standby <br />service is provided, pursuant to Section <br />31-21 of the Santa Ana Municipal Code, for <br />those services acquired by the City of Santa <br />Ana under and pursuant to that certain agree- <br />ment entitled "Water Systems Acquisition Agree- <br />ment'', form dated 4/21/78, as amended, provided <br />and excepting, however, that the surcharge levied <br />hereby shall not apply to any dwelling in Tract <br />1944, the owners of which installed a water sys- <br />tem under and pursuant to proceedings had and <br />taken under the Improvement Act of 1911 heretofore. <br />The surcharge levied hereby shall not be charged <br />beyond ten (10) years from and and after the <br />date when said surcharge is first levied. <br /> <br /> 2. This resolution shall be operative from and <br />after the date of closing that is referred in said "Water <br />Systems Acquisition Agreement", which said date determines, <br />or will determine, when and if the City of Santa Aha succeeds <br />to ownership of the water system that is the subject of said <br />agreement. <br /> <br />ADOPTED this 5th day of June , <br />1978, by the following vote: <br /> <br /> Ward, Yamamoto, Bricken, Garthe, <br /> AYES: COUNCILMEN: Brandt, Ward <br /> <br /> NOES: COUNCILMEN: Evans <br /> None ~ ~, <br /> <br />ABSENT: COUNCILMEN: <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />MAYOR <br /> <br />APPROVED AS TO FORM: <br /> <br />KEITH L.
