KLG:nr <br />3-8-79 <br /> <br />RESOLUTION NO. 79-46 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA, ADOPTED PURSUANT TO THE PROVI- <br />SIONS OF SECTION 10061 OF THE STATE PUBLIC <br />UTILITIES CODE, CONCURRING IN THE SALE TO <br />SAID CITY OF A CERTAIN WATER SYSTEM, AND THE <br />TERMS AND CONDITIONS THEREOF, AND BINDING <br />SAID CITY TO RENDER WATER SERVICE TO THE <br />PERSONS FORMERLY SERVED THROUGH THE SYSTEM <br />BEING ACQUIRED ON TERMS AND CONDITIONS WHICH <br />ARE JUST AND REASONABLE AND WHICH DO NOT <br />UNREASONABLY DISCRIMINATE AGAINST THE CUSTO- <br />MERS OF THE ACQUIRED ENTITY. <br /> <br /> WHEREAS, this Council has heretofore authorized <br />execution, on behalf of the City of Santa Ana, of that <br />certain "Water Systems Acquisition Agreement", form dated <br />7/8/78, a copy of which is on file in the office of the <br />Clerk of the Council, to which copy reference is hereby made <br />for full particulars, and <br /> <br /> WHEREAS, under the provisions of said agreement, the <br />City of Garden Grove agrees to sell and the City of Santa <br />Ana agrees to buy, a certain portion of the public utility <br />owned and operated by Garden Grove for furnishing water <br />service, said portion being so much thereof as is situate <br />within the geographic boundaries of the City of Santa Ana. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA: <br /> <br /> That this Council hereby concurs in such sale and <br />transfer of said portion of said publicly owned and operated <br />public utility, and the terms and conditions thereof, and <br />that the City of Santa Ana will be bound to render water <br />service to the persons formerly served through the system <br />being sold on terms and conditions which are just and <br />reasonable and which do not unreasonably discriminate <br />against the customers of the acquired entity. <br /> <br />ADOPTED this <br /> <br />1Zth day of March <br /> <br />1979. <br /> <br /> AYES: <br /> NOES: <br /> ABSENT: <br /> <br />ATTEST: <br /> <br />CLERK OF THE ~OU~I~/ <br /> <br />COUNCILMEN: Brandt, Garthe, 0rtiz, Ward, <br /> Yamamoto <br />COUNCILMEN: Bricken, Evans <br /> <br />COUNCILMEN: None <br /> MAY~OR <br /> <br />APPROVED AS TO FORM: <br /> <br />KEITH L.
