KLG:ar <br />4/11/79 <br /> <br />RESOLUTION NO. 79-62 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING MODIFICATION OF SECTION 2. <br /> D.(6) OF THE JOINT POWERS AGREEMENT OF 1974 <br /> (INTER-COUNTY AIRPORT AUTHORITY) <br /> <br /> WHEREAS, the Inter-County Airport Authority was created <br />as a public agency by a Joint Powers Agreement between the <br />Cities of Chino, Garden Grove, Santa Ana and Stanton pur- <br />suant to provisions authorizing such Joint Powers Agreement <br />found in the Government Code of the State of California <br />commencing with Section 6500; and <br /> <br /> WHEREAS, Section 10 of that Joint Powers Agreement <br />provides that it may be amended by mutual consent of the <br />participating cities; and <br /> <br /> WHEREAs, the Governing Board of the Authority considers <br />that it may be desirable for both economic and continuity <br />reasons from time to time to rotate or re-appoint its Legal <br />Counsel annually; and <br /> <br /> WHEREAS, at their Regular Meeting held on January 17, <br />1979 at the established time and place the members present <br />did, by unanimous vote, direct that a request for modifi- <br />cation of Section 2.D.(6) of the Joint Powers Agreement be <br />forwarded to each participating city for approval of the <br />proposed modification; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA: <br /> <br /> That Section 2.D.(6) of the Joint Powers Agreement is <br />amended to read as follows: <br /> <br />"(6) Attorney <br /> <br /> The Attorney for the AUTHORITY shall be <br />the duly appointed and acting City Attorney (or <br />his duly authorized deputy) of a participating <br />City (in the order of participation) on a rota- <br />tional basis for one year, serving ex officio <br />as Attorney for the AUTHORITY. The Board shall <br />annually have the discretion to determine that <br />if it is in the best interest of the joint <br />powers cities to reappoint the AUTHORITY Attorney <br />without regard to a rotational basis, it may do <br />so with the consent of the Attorney and the <br /> <br /> <br />
