EJC:adg <br />5/3/79 <br /> <br />RESOLUTION NO. 79-68 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA REQUESTING THE STATE <br />LEGISLATURE TO AMEND SECTION 3202 OF THE <br />LABOR CODE OF THE STATE OF CALIFORNIA <br />RELATING TO WORKERS' COMPENSATION <br /> <br /> WHEREAS, the Santa Ana City Council is concerned <br />about the increasing costs to employers for industrial <br />injury and disability retirements; and <br /> <br /> WHEREAS, the Santa Ana City Council believes that <br />the primary reason for such rising costs is the mandate <br />provided in Section 3202 of the Labor Code that the courts <br />liberally construe the Workers' Compensation Insurance and <br />Safety in Em~ployment provisions of the Labor Code with the <br />purpose of extending their benefits for the protection of <br />persons injured in the course of their employment; and <br /> <br /> WHEREAS, Assemblyman Paul Bannai (Gardena) has <br />proposed legislation in an attempt to amend Section 3202 of <br />the Labor Code by substituting the words "fair and <br />equitably" for the word "liberally;" and <br /> <br /> WHEREAS, the City Council of the City of Seal <br />Beach, by its Resolution No. 2866, has requested the State <br />Legislature to take action in an effort to halt rising costs <br />associated with workers' compensation benefits beyond the <br />original purpose and intent of the law; and <br /> <br /> WHEREAS, such proposals are believed by the Santa <br />Ana City Council to be necessary in an effort to reduce high <br />costs which have been and are occurring in the areas of <br />industrial injury and disability retirement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br />of the City of Santa Ana: <br /> <br /> 1. That the California State Legislature is <br />requested to pass legislation amending Section 3202 of the <br />Labor Code of the State of California to provide for "fair <br />and equitable" construction of the Workers' Compensation <br />Insurance law and the Safety in Employment law rather than <br />"liberal" construction. <br /> <br /> 2.
