RESOLUTION NO. 79-91 <br /> <br />RESOLUTION OF THE CITY COUNCIL OVERRULING <br />AND DENYING PROTESTS AND MAKING CERTAIN <br />FINDINGS ~.D. 241 - SANTA ANITA NORTHEAST) <br /> <br />CITY OF SANTA ANA <br /> <br />WHEREAS, this City Council has held and conducted a Public Hearing <br />on the confirmation of the assessments and acceptance of the works <br />of improvement in a special assessment district with the terms and <br />proceedings being conducted pursuant to the provisions of the "Im- <br />provement Act of 1911", being Division 7 of the Streets and Highways <br />Code of the State of California; said special assessment district <br />known and designated as <br /> <br />ASSESSMENT DISTRICT NO. 241 <br /> <br />(hereinafter referred to as the "Assessment District"); and, <br /> <br />WHEREAS, certain owners of property liable to be assessed for cer- <br />tain works of improvement have filed written protests or objections <br />and delivered the same to the City Clerk not later than the hour <br />set for the hearing thereon, and said protests have been presented <br />to the City Council for their consideration, and this Council has <br />proceeded to hear the same and is now ready to proceed with the <br />confirmation of the assessments and acceptance of the works of <br />improvement. <br /> <br />NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br /> <br />CITY OF SANTA ANA <br /> <br />CALIFORNIA, AS FOLLOWS: <br /> <br />SECTION 1. That the above recitals are all true and correct. <br /> <br />SECTION 2. <br /> <br />That all protests and objections of every kind and <br />nature be, and the same hereby are, overruled and <br />denied. <br /> <br />SECTION 3. <br /> <br />That it is hereby further determined that all pro- <br />perties within the boundaries of the Assessment <br />District do receive a local and direct benefit from <br />the works of improvement and that the assessable <br />costs and expenses have been apportioned and spread <br />against the properties within the Assessment Dist- <br />rict in direct proportion to benefits received thereto. <br /> <br />SECTION 4. <br /> <br />That the Engineer's method and formula of assessment <br />spread is equitable and hereby approved by this City <br />Council as being a correct and proper apportionment <br />and distribution of all assessable costs in re%ation <br />to the benefits received from the works of improve- <br />ment constructed under these proceedings. <br /> <br /> <br />
