DMF/fm <br />6/26/79 <br /> <br />RESOLUTION NO. 79-105 <br /> <br />A RESOLUTION OF THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AUTHORIZING <br />LOANS OF COMMUNITY DEVELOPMENT BLOCK <br />GRANT FUNDS RECEIVED FROM THE UNITED <br />STATES DEPARTMENT OF HOUSING AND URBAN <br />DEVELOPMENT TO CERTAIN QUALIFIED <br />PROPERTY OWNERS FOR THE PURPOSE OF <br />PAYING ALL OR A PORTION OF THE PROPERTY <br />OWNERS' SHARES OF SPECIAL ASSESSMENTS <br /> <br /> WHEREAS, federal regulations (24 CFR 570.200(f)) <br />provide that Community Development Block Grant ("CDBG") <br />funds received from the United States Department of Housing <br />and Urban Development ("HUD") may be used to pay the share <br />of costs of public improvement of property owned or occupied <br />by low- and moderate-income households in a special assess- <br />ment district; and <br /> <br /> WHEREAS, CDBG funds in the amount of $64,000 were <br />approved by the City Council in the fourth year CDBG budget <br />for loans to needy low- and moderate-income property owners <br />in special assessment districts to pay their share of costs <br />of public improvements in said districts; and <br /> <br /> WHEREAS, Assessment District 241 was created in <br />the City of Santa Ana in accordance with the "Improvement <br />Act of 1911," California Streets and Highways Code Section <br />5000 e__t seq. by Resolutions 78-15 and 78-16; and <br /> <br /> WHEREAS, the City Council passed Resolution 79-93 <br />confirming assessments in Assessment District 241 pursuant <br />to the Improvement Act of 1911 on June 4, 1979; and <br /> <br /> WHEREAS, Section 5129 of the California Streets <br />and Highways Code permits use of federal funds for the <br />payment of assessments levied, on lands owned and occupied <br />by low- and moderate-income households, by legislative <br />bodies in special assessment districts created under the <br />Improvement Act of 1911; and <br /> <br /> WHEREAS, the City of Santa Ana desires to lend <br />Community Development Block Grant funds received from HUD to <br />pay all or a portion of special assessments on properties <br />owned and occupied by certain qualified low-income households <br />in Assessment District 241 in amounts not greater than <br />$800.00 for each benefited property. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA, that loans using Community Develop- <br />ment Block Grant funds to pay all or a portion of the share <br />of costs of public improvements benefiting properties owned <br />and occupied by qualified low- and moderate-income households <br /> <br /> <br />
