KLG: ar <br />7/26/79 <br /> <br />RESOLUTION NO. 79-126 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA ENCOURAGING LEGISLATION TO ENSURE <br />REASONABLE TIME LIMITS BETWEEN EACH STEP OF <br />THE RECALL PROCESS <br /> <br /> WHEREAS, the procedures for recall of elected city <br />officials are established by the State Leqislature and set <br />forth in the State Elections Code; and <br /> <br /> WHEREAS, the Elections Code currently provides elected <br />officials seven (7) days in which to respond to a formally <br />presented Notice of Intention tO Circulate a Recall <br />Petition; and <br /> <br /> WHEREAS, once such Notice has been responded to by the <br />elected official, the Elections Code does not impose a <br />deadline by which the recall initiator(s) must submit the <br />Notice the Clerk of the Council for certification and <br />approval of the recall petition; and <br /> <br /> WHEREAS, this omission in the Elections Code has <br />created a situation whereby the recall initiator(s) can <br />prolong the recall process and, thus, cause great harm to <br />elected officials by subjecting their credibility and <br />character to doubt and inhibiting the performance of their <br />duties; and <br /> <br /> WHEREAS, the lack of a reasonable time limit for <br />submission of the Notice to the Clerk of the Council is an <br />invitation to abuse the recall process. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA, AS FOLLOWS: <br /> <br /> That this Council hereby requests the League of <br />California Cities to seek leqislation to amend the Elections <br />Code to provide a specific and definite time limit between <br />all of the steps in the recall process; <br /> <br /> That this resolution be forwarded to the League of <br />California Cities prior to August 9, 1979 for consideration <br />by the General Assembly at their 1979 Annual Conference in <br />San Francisco. <br /> <br /> ADOPTED this 6th <br />by the following vo-~: <br /> <br />day of August , 1979, <br /> <br />AYES: <br /> <br />NOES: <br /> <br />ABSENT: <br /> <br />COUNCILMEN: <br />COUNCILMEN: <br />COUNCILMEN: <br /> <br />Bricken, Griset, Luxembourger, Serrato, Ward, <br /> Yamamoto <br /> <br />Markel <br /> <br />None <br /> <br />ATTEST: <br /> <br />APPROVED AS TO FORM: <br /> <br />CITY ATTORNEY <br /> <br /> <br />
