REL:ms <br />8/13/79 <br /> <br />RESOLUTION NO. 79-136 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA OVERRULING THE <br />DECISION OF THE PLANNING COMMISSION <br />DENYING CONDITIONAL USE PERMIT NO. <br />79-9, GRANTING APPEAL NO. 407, AND <br />GRANTING SAID CONDITIONAL USE PERMIT. <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council of the City of Santa Ana on August 6, 1979, on <br />the action taken by the Planning Commission in denying <br />Conditional Use Permit No. 79-9, which application seeks to <br />allow conversion of ninety apartment units to condominiums <br />at 618, 630 North Baker Street in the R1, R2, C4, and C5 <br />Districts; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby overrule the action of the Planning <br />Commission in denying Conditional Use Permit No. 79-9, and <br />does hereby grant Appeal No. 401 and Conditional Use Permit <br />No. 79-9, subject to all requirements and conditions as <br />recommended by the Planning Director. <br /> <br /> 2. That the City Council hereby adopts as its <br />findings of fact for Conditional Use Permit No. 79-9, that <br />certain "Finding of Fact, Conditional Use Permit No. 79-9," <br />prepared and submitted by the Planning Commission, on file <br />in the Office of the Clerk of the Council, and incorporated <br />by reference herein as though fully set forth. <br /> <br /> ADOPTED this 20th day of <br />by the following vote: <br /> <br />AuKust , 1979, <br /> <br />AYES: <br /> <br />COUNCILMEN: Bricken, Griset, Luxembourger, Ward, Yamamoto <br /> <br />NOES: <br /> <br />COUNCILMEN: Markel, Serrato <br /> <br />ABSENT: COUNCILMEN: None <br /> <br />ATTEST: <br /> <br />APPROVED AS TO FORM: <br /> <br />KEITH L.
