CTD/fm <br />10/25/79 <br /> <br />RESOLUTION NO. 79- 198 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA IN SUPPORT OF THE SB 90 <br />CLAIM OF THE COUNTY OF LOS ANGELES FORESTER <br />AND FIRE WARDEN AND CONSOLIDATED FIRE <br />PROTECTION DISTRICTS FOR REIMBURSEMENT <br />FOR FIRE CLOTHING AND EQUIPMENT REQUIREMENTS <br />FORMULATED BY THE OCCUPATIONAL SAFETY AND <br />HEALTH STANDARDS BOARD <br /> <br /> WHEREAS, the Occupational Safety and Health Standards <br />Board of the State of California did on or about April 27, <br />1978 adopt certain requirements for clothing and equipment for <br />structural fire fighters which are set forth at Title 8 <br />California Administrative Code Sections 3401 - 3409; and <br /> <br /> WHEREAS, prior to the aforementioned requirements no <br />specific regulations existed which were applicable to clothing <br />and equipment of structural fire fighters employed by local <br />government; and <br /> <br /> WHEREAS, the aforementioned requirements constitute <br />a cost mandated by the State upon the City of Santa Ana as <br />defined in Revenue and Taxation Code Section 2207; and <br /> <br /> WHEREAS, the County of Los Angeles Forester and Fire <br />Warden and Consolidated Fire Protection Districts have filed <br />a claim for themselves, and all similarly situated governmental <br />entities, before the State Board of Control for costs <br />mandated by the aforementioned State regulations, which have not <br />been reimbursed pursuant to Revenue and Taxation Code, Section <br />2231; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA: <br /> <br /> That this Council declares its support for the <br />aforementioned claim as a State mandated cost caused by an <br />executive order issued by the Occupational Safety and Health <br />Standards Board which should be totally reimbursed by the <br />State of California.
