RESOLUTION NO. 79- 223 <br /> <br />RESOLUTION OF THE CITY COUNCIL CONFIRMING <br />THE ASSESSMENT PURSUANT TO "IMPROVEMENT <br />ACT OF 1911", BEING DIVISION 7 OF THE <br />STREETS AND HIGHWAYS CODE OF THE STATE OF <br />CALIFORNIA. (A.D. 242 - PROGRESSO-LA BONITA & <br />SIXIH-R0SITA) <br /> CITY OF SANTA ANA <br /> <br />WHEREAS, there has been filed with the Clerk of the Council an <br />assessment to represent the costs and expenses of the work and <br />improvements done pursuant to proceedings had and taken under <br />the provisions of the "Improvement Act of 1911", being Division <br />7 of the Streets and Highways Code of the State of California, <br />and pursuant to Resolution of Intention No. 78-68 , all <br />within the boundaries of a special assessment district known and <br />designated as <br /> <br /> ASSESSMENT DISTRICT NO. 242 <br /> <br />(hereinafter referred to as the "Assessment District"); and, <br /> <br />WHEREAS, the Clerk of the Council has duly given notice in the <br />manner provided by law of the filing of'said assessment and of the <br />time set for hearing; and, <br /> <br />WHEREAS, said Clerk of the Council is now satisfied as to the <br />proper completion of the work and of the spreading of the assessment. <br /> <br />NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br /> <br />CITY OF SANTA ANA <br /> <br />CALIFORNIA, AS FOLLOWS: <br /> <br />SECTION'I. Tha~ the above recitals are all true and correct. <br /> <br />SECTION 2. <br /> <br />That the assessment and diagram, the proceedings <br />leading up to the same, and all acts and determin- <br />ations of the officers and agents of said City <br />in relation to the work done and appurtenances <br />· and appurtenant work in said Assessment District <br />and to the said assessment, and the diagram <br />attached thereto, be, and the same are, hereby <br />ratified and confirmed, the work and improvement <br />is accepted, and the Superintendent of Streets <br />is hereby ordered and directed to attach to said <br />assessment a warrant in the manner and form pro- <br />vided by law, said warrant bearing date of this <br />Resolution, and is further ordered to deliver <br />said warrant, diagram and assessment to the <br />Contractor, or its assignee, as the case may be, <br />forthwith upon payment of the incidental expenses <br />due thereon. <br /> <br />SECTION 3. <br /> <br />That the assessment roll, warrant and diagram <br />shall be recorded in the Office of the Superintendent <br />of Streets and immediately thereafter the Clerk <br />of the Council shall file a copy of the assessment <br />diagram in the Office of the County Recorder, and <br /> <br /> <br />
