REL:ms <br />4/2.8/80 <br /> <br />RESOLUTION NO. 80-81 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA OVERRULING THE <br />ZONING ADMINISTRATOR'S APPROVAL OF <br />MINOR EXCEPTION APPLICATION <br />80-12 AND DENYING SAID MINOR EXCEPTION <br />APPLICATION. <br /> <br /> WHEREAS, on May 19 , 1980, a public hearing was <br />duly held before the City Council of the City of Santa Ana <br />on Minor Exception Application 80-12, which seeks to allow <br />the sale of beer and wine in a proposed market within an <br />existing service station, at 3312 West First Street in the <br />C2 District; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br />of the City of Santa Ana as follows: <br /> <br /> 1. That based on such public hearing and on the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby overrule the Zoning Administrator's <br />approval of Minor Exception Application 80-12 and does <br />hereby deny said Minor Exception Application. <br /> <br /> 2. That the City Council hereby adopts as its <br />findings of fact for denial of said Minor Exception Application, <br />the following: <br /> <br />(a) <br /> <br />First Street, between Harbor Boulevard and <br />the Santa Ana River, presently provides two <br />establishments in which alcoholic beverages <br />are sold for off-site consumption and three <br />establishments in which alcoholic beverages are <br />sold for on-site consumption. <br /> <br />(b) The public is adequately served by such <br /> existing establishments within the area. <br /> <br />(c) <br /> <br />An over-concentration of establishments <br />selling alcoholic beverages in a limited area <br />is detrimental to development and future <br />occupancy of property in such area to its <br />highest and best use. <br /> <br />(d) <br /> <br />The addition of another establishment selling <br />beer and wine, as proposed in this minor <br />exception application, is not necessary or <br />desirable, in that it will not provide a <br />service or facility which will contribute to <br />the general wellbeing of the neighborhood or <br />the community. <br /> <br /> <br />
