RESOLUTION NO. 80-100 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA SUPPORT- <br />ING ASSEMBLY BILL 2376 <br /> <br /> WHEREAS, Revenue and Taxation Code Section 99(b) provides <br />that municipal annexations shall not become effective until the <br />governing bodies of all agencies, whose service areas or service <br />responsibilities would be altered thereby, shall meet to determine <br />the amount of property tax revenues to be exchanged between and <br />among such affected agencies; and <br /> <br /> WHEREAS, the current procedure makes no provision which <br />would permit the annexations to take effect in the event the affect- <br />ed taxing agencies are unable to agree upon a tax revenue allocation; <br />and <br /> <br /> WHEREAS, current law permits the County to impound all <br />tax revenues until such negotiations are completed; and <br /> <br /> WHEREAS, the League of California Cities has sponsored <br />AB 2376 (Lancaster) which authorizes the County Auditor to appor- <br />tion property tax revenues according to a fixed formula based upon <br />service responsibilities transferred to the successor agency in the <br />event a negotiated agreement is not reached among the taxing agencies <br />by September 1 of any year; and <br /> <br /> WHEREAS, AB 2376 would establish an expeditious manner to <br />permit annexations to become effective in instances where the taxing <br />agencies are unable or unwilling to negotiate an exchange of tax <br />revenues. <br /> <br /> NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL: That <br />the City of Santa Ana does hereby support Assembly Bill 2376 and <br />urges its passage. <br /> <br /> Be it further resolved that a certified copy of this <br />resolution shall be forwarded to the Executive Director of the <br />Orange County League of California Cities, each City in the County <br />of Orange, and, all State Assemblymen in Orange County. <br /> <br /> ADOPTED this 16th day of June , 1980, by <br />the following vote: <br /> <br />ATTEST: <br /> <br />AYES: <br /> <br />NOES: <br /> <br />ABSENT: <br /> <br />COUNCILMEN: <br />COUNCILMEN: <br />COUNCILMEN: <br /> <br />APPROVED AS TO FORM: <br /> <br />CITY ATTORNEY ~ <br /> <br />Bricken, Griset, Luxembourger, <br />Markel, Serrato, Yamamoto <br />None <br /> <br />Ward <br /> <br />R <br /> <br /> <br />
