REL:adg <br />s/21/80 <br /> <br />RESOLUTION NO. 80-144 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA OVERRULING THE ZONING <br />ADMINISTRATOR'S DENIAL OF MINOR EXCEPTION <br />APPLICATION 80-32, GRANTING APPEAL NO. 420 <br />AND APPROVING MINOR EXCEPTION NO. 80-32. <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council on August 18, 1980, on the action taken by the <br />Zoning Administrator in denying Minor Exception Application <br />No. 80-32, which application seeks to allow sale of beer and <br />wine for off-site consumption in a delicatessen at 1510 West <br />Edinger in the C5 District; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br />of the City of Santa Ana as follows: <br /> <br /> 1. That based on such public hearing and the oral <br />and documentary evidence submitted therein, the City Council <br />does hereby reverse the action of the Zoning Administrator, <br />grant Appeal No. 420, and approve Minor Exception No. 80-32. <br /> <br /> 2. That the City Council adopts as its findings <br />of fact and conditions of approval for the approval of the <br />said Minor Exception that certain report entitled "Finding <br />of Fact, Minor Exception 80-32," submitted by the Zoning <br />Administrator and on file in the office of the Clerk of the <br />Council with the exception that "Reason for Decision" (a) <br />therein is amended to read as follows: <br /> <br />"The proposed use is desirable as <br />contributing to the general well-being <br />of the neighborhood, as existing establish- <br />ments in the area do not make up a very <br />heavy concentration of liquor licenses." <br /> <br /> ADOPTED this 2nd day of September , 1980, by <br />the following vote: <br /> <br />AYES: COUNCILMEN: <br />NOES: COUNCILMEN: <br /> <br />BRICKEN, GRISET, LIJXEMBOURGER, <br />SERRATO <br />WARD, YAMAMOTO <br /> <br /> ABSENT: COUNCILMEN: <br /> <br />ATTEST: <br /> <br />APPROVED AS TO FORM: <br /> <br />MARK~L <br /> <br />EDWARD J. ~OOP~3 <br />CITY ATTORNEY <br /> <br /> <br />
