RESOLUTION NO. 80-207 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 19 <br /> <br /> WHEREAS, by Minute Order dated November 3, 1980, a public hearing <br />was called for November 17, lg80 at the hour of 7:30 p.m., at the Council <br />Chambers of the City Hall, 22 Civic Center Plaza, Santa Ana, California, to <br />ascertain whether the public necessity, health, safety, or welfare requires <br />the removal of poles, overhead wires and associated overhead structures, <br />and the underground installation of wires and facilities for supplying <br />electrical communication or similar or associated service, for the formation <br />of the Underground Utility District No. 19 within that certain area of the <br />City described as follows: said certain area being bounded southerly by <br />the north line of Sunflower Avenue, bounded northerly by the south line <br />of MacArthur Boulevard, bounded westerly by the City Limits and easterly by a <br />line 70 feet from the center line of Harbor Boulevard, as shown on the <br />attached Exhibit "A"; <br /> <br /> WHEREAS, notice of such hearing has been given to all affected <br />property owners as such are shown on the last equalized assessment roll and <br />to all utilities concerned in the manner and within the time required by <br />law; and <br /> <br /> WHEREAS, such hearing has been duly and regularly held, and all <br />persons interested have been given an opportunity to be heard: <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Santa Ana: <br /> <br /> 1. That pursuant to Santa Ana Municipal Code Sections 37-1 to <br />37-13, the above-described area is hereby declared an Underground Utility <br />District, and is designated as Underground Utility District No. 19 of the <br />City of Santa Ana. Attached hereto, marked Exhibit "A", and hereby incor- <br />porated as a part of this Resolution, is a map delineating the boundaries <br />of said District. <br /> <br /> 2. That the City Council does hereby fix November l, lg81 as the <br />date on which affected property owners must be ready to receive underground <br />service, and does hereby order the removal of all poles, overhead wires and <br />associated overhead structures and the underground installation of wires and <br />facilities for supplying electric, communication, or similar or associated <br />service within Underground Utility District No. 19 on or before November 1, 1981. <br /> <br /> 3. That the Clerk of the Council is hereby instructed to notify <br />all affected utilities and all persons owning real property within Underground <br />Utility District No. 19 of the adoption of this Resolution within ten (10) days <br />after the date of such adoption. Such notification shall be made by mailing a <br />copy of this resolution, together with a copy of said Santa Aha Municipal Code <br />Sections 37-1 to 37-13 to all affected property owners as such are shown on <br />the last equalized assessment roll and to the affected utilities. <br /> <br /> 4. That the City Council of the City of Santa Ana hereby finds and <br />determines as follows, upon the basis of the evidence presented at said hearing; <br />that the public necessity, health, safety and welfare require the removal of <br />poles, overhead wires and associated overhead structures within said area of <br />the City, and the underground installation of wires and facilities for sup- <br />plying electric, communication, and similar or associated service, so as to <br />eliminate hazards caused by fallen lines and poles and to improve visibility <br />of pedestrian traffic to vehicle drivers. <br /> <br /> <br />
