REL:adg <br />11/24/80 <br /> <br />RESOLUTION NO. 80-211 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AFFIRMING WITH MOD- <br />IFICATIONS THE PLANNING COMMISSION'S <br />APPROVAL OF VARIANCE NO. 80-15 AND <br />DENYING APPEAL NO. 422 <br /> <br /> WHEREAS, On November 17, 1980, a public hearing <br />was duly held before the City Council of the City of Santa <br />Ana on Variance Application No. 80-15, which seeks to allow <br />construction of an office building with less than required <br />parking and required setback from residentially zoned <br />properties at 1801 E. Fourth Street in the LP, HDI District; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and on the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby affirm the Planning Commission's action <br />in approving Variance No. 80-15, subject to certain <br />modifications as hereinafter set forth, and does deny Appeal <br />No. 422, filed thereon. <br /> <br /> 2. That the City Council hereby adopts as its <br />findings of fact for approval of said Variance, that certain <br />report entitled "Variance Application No. 80-15," submitted <br />by the Planning Commission and on file in the office of the <br />Clerk of the Council. <br /> <br /> 3. That prior to approving the said Variance, <br />this Council reviewed and considered the information <br />contained in the Negative Declaration prepared for the <br />project, and does approve and affirm the same. <br /> <br /> 4. That the said Variance is approved subject to <br />the same requirements as set forth in the abovesaid report <br />of the Planning Commission, except as follows: <br /> <br /> (a) That requirement in the said report <br />numbered 7.A(1)(b) is deleted. <br /> <br /> (b) That requirement in the said report <br />numbered 7.A(1)(c) is amended by changing phrase (1) <br />thereof to read: "a minimum 20-foot, bermed landscaped <br />setback on Parkcourt Place, unless an acceptable <br />alternative is approved by the Director of Planning." <br /> <br /> (c) In addition to the requirements in the <br />said report, this approval of the said Variance is <br />also subject to the following requirement: <br /> <br /> <br />
