REL:adg <br />1/20/82 <br /> <br />RESOLUTION NO. 82-9 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA APPROVING THE <br />DESTRUCTION OF CERTAIN RECORDINGS OF <br />TELEPHONE AND RADIO COMMUNICATIONS <br />PURSUANT TO SECTION 34090.6 OF THE <br />GOVERNMENT CODE OF THE STATE OF <br />CALIFORNIA (POLICE DEPARTMENT) <br /> <br /> WHEREAS, the Chief of Police has submitted a <br />request for authority to destroy certain recordings of <br />telephone and radio communications; and <br /> <br /> WHEREAS, said request has been approved by the <br />City Attorney and is recommended for approval by the City <br />Manager, and is in accordance with the procedures and <br />requirements of the City and Section 34090.6 of the <br />California Government Code; and <br /> <br /> WHEREAS, said request is to destroy the original <br />recordings which are more than 100 days old and are made in <br />the routine daily taping and recording of telephone <br />communications to and from the police Department of the City <br />of Santa Ana and all radio communications relating to the <br />operations of said department; <br /> <br /> NOW, THEREFORE BE IT RESOLVED by the City Council <br />of the City of Santa Ana as follows: <br /> <br /> 1. Subject to the conditions and exceptions <br />hereinafter set forth, the Chief of Police is hereby <br />authorized to destroy all tape recordings over 100 days old <br />of the following: <br /> <br />a. Daily telephone communications. <br /> <br />Radio communications relating to Police <br />Department operations. <br /> <br /> 2. The recordings specified in paragraph 1 of this <br />Resolution shall not include any recordings of citizen <br />complaints, or investigations in response to citizen <br />complaints, relating to members of the Police Department, <br />nor to Internal Investigation files, unless a reproduction <br />of the original has been made on a suitable magnetic device. <br /> <br /> <br />
