REL:adg <br />12/12/80 <br /> <br />RESOLUTION NO. 81-1 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA REVERSING THE ACTION <br />OF THE PLANNING COMMISSION ON VARIANCE <br />APPLICATION NO. 80-33, APPROVING SAID <br />VARIANCE AND GRANTING APPEAL NO. 423. <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council of the City of Santa Ana on December 8, 1980, <br />on the action taken by the Planning Commission in denying <br />Variance Application No. 80-33, which application seeks to <br />waive zoning regulations restricting the location and height <br />of an existing outdoor advertising sign and a second outdoor <br />advertising sign to be constructed at 2140 South Ritchey <br />Street in the M1 District. <br /> <br /> WHEREAS, prior to taking action on said <br />Conditional Use Permit Application, this Council has <br />reviewed and considered the Negative Declaration for <br />project, including Initial Study No. IS-80-129; <br /> <br />the <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby reverse the action of the Planning <br />Commission denying said Variance Application No. 80-11, and <br />does hereby approve said Variance and grant Appeal No. 423. <br /> <br /> 2. That the City Council <br />findings of fact for the approval of <br />following: <br /> <br />hereby adopts, as its <br />Variance No. 80-11, the <br /> <br />(a) Special circumstances applicable to the <br />subject property exist in that the existing <br />sign presents an unattractive view from the <br />rear which is improved by the construction <br />of the second sign. <br /> <br />(b) The property owner's right to obtain <br />maximum use of his property consistent with <br />the purpose and intent of the zoning regu- <br />lations is preserved by the granting of this <br />Variance. <br /> <br />(c) The subject sign will not have a signifi- <br />can~ adverse effect on property in the vicinity, <br />due to the circumstances of its location and <br />surroundings. <br /> <br />(d) The subject sign will not have a signifi- <br />cant adverse effect on the future development <br />of the surrounding area in accordance with the <br />General Plan of the City. <br /> <br /> 3. For the reasons set forth in the Negative <br />Declaration prepared for this project, the Council approves <br />and adopts the said Negative Declaration and its finding <br />that the project will not have a significant effect on the <br />environment. <br /> <br /> <br />
