****RECINDED BY RES. 87-15 - Feb. 2, 1987'** <br /> CM:ms <br /> 12/30/80 <br /> <br />RESOLUTION NO. 81-3 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA OVERRULING THE <br />ACTION OF THE PLANNING COMMISSION ON <br />VARIANCE APPLICATION NO. 80-58, APPROVING <br />SAID VARIANCE~ AND GRANTING APPEAL NO. 427. <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council of the City of Santa Ana on December 15, 1980, <br />on the action taken by the Planning Commission in denying <br />Variance Application No. 80-58, which application seeks to <br />waive a portion of the yard and parking requirements for the <br />development of the Orange County Rescue Center at 120 South <br />Daisy Street in the M1 District; and <br /> <br /> WHEREAS, prior to taking action on said Variance <br />Application, this Council has reviewed and considered the <br />Negative Declaration for the project, including Initial <br />Study No. IS 80-212; <br /> <br /> NOW~ THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby reverse the action of the Planning <br />Commission denying said Variance Application No. 80-58, and <br />does hereby approve said Variance and grant Appeal No. 427. <br /> <br /> 2. That the City Council adopts, as its findings <br />of fact for the approval of Variance No. 80-58, the following: <br /> <br /> (a) The strict application of the zoning <br />ordinance is found to deprive the subject property <br />of privileges not otherwise at variance with the <br />intent and purpose of said ordinance due to special <br />circumstances applicable to said property as <br />follows: <br /> <br /> (1) The subject property, although <br />zoned M-i, is located in a block with other <br />uses of a general commercial nature and with <br />nonconforming yard areas. Subject property <br />shall be provided with a five (5) foot wide <br />landscaped strip adjacent to the Daisy and <br />Walnut Streets frontages, consistent with <br />landscape requirements in commercial districts. <br /> <br /> (2) The subject property shall be <br />provided with twelve (12) on-site parking <br />spaces, which is adequate for the proposed <br />use. Historically, clientele of the Rescue <br />Center have not been motor vehicle operators <br />and the provided spaces meet code requirements <br />for the office and staff lodging aspects of <br />said Rescue Center. <br /> <br /> (b) The variance is necessary to develop the <br />subject property in order to provide a facility to <br />serve the needs of the community. <br /> <br /> <br />
