REL: adg <br />2/5/81 <br /> <br />RESOLUTION NO. 81- 24 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA OVERRULING THE <br />ZONING ADMINISTRATOR'S DENIAL OF <br />MINOR EXCEPTION APPLICATION 80-60, <br />GRANTING APPEAL NO. 432 AND APPROVING <br />MINOR EXCEPTION NO. 80-60. <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council on February 2, 1981, on the action taken by the <br />Zoning Administrator in denying Minor Exception Application <br />No. 80-60, which application seeks to allow sale of beer and <br />wine for off-site consumption in an existing market at 1120 <br />South Bristol Street in the C1 District; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br />of the City of Santa Ana as follows: <br /> <br /> 1. That based on such public hearing and the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby reverse the action of the Zoning <br />Administrator, grant Appeal No. 432, and approve Minor <br />Exception No. 80-60. <br /> <br /> 2. That the City Council adopts as its findings <br />of fact and conditions of approval for the approval of the <br />said Minor Exception that certain report entitled "Finding <br />of Fact, Minor Exception 80-60," submitted by the Zoning <br />Administrator and on file in the office of the Clerk of the <br />Council with the exception that "Finding" (a) therein is <br />amended to read as follows: <br /> <br />"The proposed use is desirable as contributing <br />to the general well-being of the neighborhood, <br />as existing establishment in the area do not <br />make up a very heavy concentration of liquor <br />licenses." <br /> <br />and Finding (b) is amended to read as follows: <br /> <br />"The circumstances of this case indicate <br />that such use will not be detrimental to <br />the health, safety or welfare of persons <br />residing or working in the vicinity or <br />injurious to property or improvements in <br />the vicinity." <br /> <br /> ADOPTED this <br />the following vote: <br /> <br /> AYES: <br /> NOES: <br /> ABSENT: <br /> <br />17thday of February , 1981, by <br /> <br />COUNCILMEN: <br />COUNCILMEN: <br />COUNCILMEN: <br /> <br />ATTEST: <br /> <br /> ~ T~O ~nO~../ <br /> <br />City Attorney <br /> <br />Griset, Luxembourger, Markel, Serrato, Ward <br /> <br />Bricken, Yamamoto <br />None <br /> ~r ~~ <br /> <br /> <br />
