REL:adg <br />3/20/81 <br /> <br />RESOLUTION NO. 8146 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA OVERRULING THE <br />ZONING ADMINISTRATOR'S APPROVAL OF <br />MINOR EXCEPTION APPLICATION 80-50 AND <br />DENYING SAID MINOR EXCEPTION APPLICATION. <br /> <br /> WHEREAS, on March 16, 1981, a public hearing was <br />duly held before the City Council of the City of Santa Ana <br />on Minor Exception Application 80-50, which seeks to allow <br />sale of beer and wine for on-site consumption in an existing <br />convenience market at 3950 South Main Street; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and on the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby overrule the Zoning Administrator's <br />approval of Minor Exception Application 80-50 and does <br />hereby deny said Minor Exception Application. <br /> <br /> 2. That the City Council hereby adopts as <br />findings of fact for denial of said Minor Exception <br />Application, the following: <br /> <br />its <br /> <br /> The proposed use is not necessary or desirable and <br />would be detrimental to the public welfare and injurious to <br />surrounding property for the reason that consumption of <br />alcoholic beverages commonly and ordinarily increases noise <br />and disturbance incident to the primary use, and such <br />increase is unacceptable because of the family-oriented <br />patronage of the subject premises. <br /> <br /> ADOPTED this 6th day of April , 1981, by <br />the following vote: <br /> <br />AYES: <br /> <br />NOES: <br /> <br />COUNCILMEMBER: <br />COUNCILMEMBER: <br /> <br />Bricken, Griset, Markel, Serrato, <br />Ward, Yamamoto <br />Luxembourger <br /> <br />ABSENT: COUNC ILMEMBER: None <br /> <br />ATTEST: <br /> <br />CITY ATTORNEY <br /> <br /> <br />
