REL: adg <br />3/20/81 <br /> <br />RESOLUTION NO. 81-48 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA OVERRULING THE ZONING <br />ADMINISTRATOR'S DENIAL OF MINOR EXCEPTION <br />APPLICATION 80-59, GRANTING APPEAL NO. 433 <br />AND APPROVING MINOR EXCEPTION NO. 80-59. <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council on March 16, 1981, on the action taken by the <br />Zoning Administrator in denying Minor Exception Application <br />No. 80-59, which application seeks to allow sale of beer and <br />wine for off-site consumption in an existing convenience <br />market within a service station in a shopping center at 3801 <br />South Bristol Street; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and the oral <br />and documentary evidence submitted therein, the City Council <br />does hereby reverse the action of the Zoning Administrator, <br />grant Appeal No. 433, and approve Minor Exception No. 80-59. <br /> <br /> 2. That the City Council adopts as its findings <br />of fact for the approval of the said Minor Exception that <br />certain report entitled "Finding of Fact, Minor Exception 80- <br />59," submitted by the Zoning Administrator and on file in <br />the office of the Clerk of the Council with the exception <br />that "Reason for Decision" (a) therein is amended to read as <br />follows: <br /> <br />"The proposed use is desirable as <br />contributing to the general well-being <br />of the neighborhood, as existing establish- <br />ments in the area do not make up a very <br />heavy concentration of liquor licenses," <br /> <br />and "Reason for Decision" (b) therein is amended to read as <br />follows: <br /> <br />"The proposed use will not have any <br />significant detrimental effect on persons <br />residing or working in the vicinity or on <br />property or improvements in the area." <br /> <br /> 3. The said minor exception is approved subject <br />to the requirements and limitations set forth in the <br />abovesaid report, and subject to the additional condition <br />that the area within the building in which beer and wine is <br />offered for sale not be expanded beyond that shown on the <br />floor plan designated "Exhibit A," submitted at the hearing <br />and on file in the Office of the Clerk of the Council. <br /> <br /> ADOPTED this <br />the following vote: <br /> <br />6th day of April , 1981, by <br /> <br /> AYES: <br /> NOES: <br /> ABSENT: <br /> <br />ATTEST: <br /> <br />ZDWABn J.- CO0 .R <br />CITY ATTORNEY <br /> <br />COUNCILMEMBER: Bricken, Griset, Luxemb0urger, Markel, <br /> Serrato <br />COUNCILMEMBER: Ward, Yamam0t0 <br />COUNC ILMEMBER: None <br /> <br /> <br />
