REL:adg <br />6/4/81 <br /> <br />RESOLUTION NO. 81-89 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA OVERRULING THE <br />ZONING ADMINISTRATOR'S DENIAL OF <br />MINOR EXCEPTION APPLICATION 81-11, <br />GRANTING APPEAL NO. 441 AND APPROVING <br />MINOR EXCEPTION NO. 81-11. <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council on June 1, 1981, on the action taken by the <br />Zoning Administrator in denying Minor Exception Application <br />No. 81-11, which application seeks to allow sale of beer and <br />wine for off-site consumption in a proposed convenience <br />market at 1200 E. McFadden Avenue in the C4 District; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br />of the City of Santa Ana as follows: <br /> <br /> 1. That based on such public hearing and the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby reverse the action of the Zoning <br />Administrator, grant Appeal No. 441, and approve Minor <br />Exception No. 81-11. <br /> <br /> 2. That the City Council adopts as its findings <br />of fact and conditions of approval for the approval of the <br />said Minor Exception that certain report entitled "Finding <br />of Fact, Minor Exception 81-11," submitted by the Zoning <br />Administrator and on file in the office of the Clerk of the <br />Council with the exception that "Finding" (a) therein is <br />amended to read as follows: <br /> <br />"The proposed use is desirable as contributing <br />to the general well-being of the neighborhood, <br />in that the proposed market, including sale of <br />beer and wine, is merely a relocation of an <br />existing such establishment from one corner <br />to another of the same intersection such as <br />will lead to site improvement without any <br />increase in adverse effects." <br /> <br />and Finding (b) is amended to read as follows: <br /> <br />"The abovesaid relocation will not be detri- <br />mental to the health, safety or welfare of <br />persons residing or working in the vicinity <br />or injurious to property or improvements <br />in the vicinity." <br /> <br />by the <br /> <br /> ADOPTED this ]5th day of <br />following vote: <br /> <br /> AYES: COUNCILMEMBERS: <br /> NOES: COUNCILMEMBERS: <br /> <br /> June , 1981, <br /> <br />Acosta, Griset, Luxemb0urger, <br />Marke], McGuigan, Serrato <br /> <br />None <br /> <br />ABSENT: COUNCILMEMBERS: Bri cken <br /> <br />ATTEST: <br /> <br />RK OF THE <br /> <br /> APPROVED AS TO FORM: <br /> <br /> <br />
