REL:adg <br />6/8/81 <br /> <br />RESOLUTION NO. 81- 95 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA RECOMMENDING <br />LEGISLATION TO INCREASE PARENTAL <br />RESPONSIBILITY FOR THE MISCONDUCT <br />OF MINOR CHILDREN <br /> <br /> WHEREAS, although the intentional misconduct of <br />minors may have been a problem of civilization throughout <br />the ages, it has been exacerbated in recent years by the <br />generally permissive attitude of our society, the courts, <br />and parents; by the disintegration of the role of the family <br />as the fundamental societal unit and the concomitant decline <br />in parental supervision of their children; by the increased <br />mobility of minors; and by the widespread accessibility and <br />use of a variety of drugs; and <br /> <br /> WHEREAS, the amount of the damages sustained by <br />the victims of such misconduct appear to have increased <br />dramatically in recent years; and <br /> <br /> WHEREAS, existing common law doctrines and <br />statutory provisions do not seem to provide either an <br />adequate remedy to the victims for the damages which they <br />incur as a result thereof or sufficient financial incentive <br />for parents to exert greater control and supervision over <br />the activities of their minor children, <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA HEREBY DOES RESOLVE THAT: <br /> <br /> Section 1. The Legislature of the State of <br />California hereby is urged to give favorable consideration <br />to legislation which would expand the scope of parental <br />financial responsibility for the misconduct of minor <br />children. Such legislation might include, but need not be <br />limited to, increasing the $5,000.00 limit of parental <br />liability for the intentional misconduct of minor children <br />which is presently provided for in Civil Code Section <br />1714.1, imposing a higher level of financial responsibility <br />upon any parent whose minor child has been previously <br />determined to have intentionally harmed other persons or <br />property, and requiring restitution for damages as part of <br />the juvenile justice system. <br /> <br /> Section 2.
