REL:adg <br />7/Z3/81 <br /> <br />RESOLUTION NO. 81-127 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA REVERSING THE <br />ACTION OF THE PLANNING COMMISSION ON <br />VARIANCE APPLICATION NO. 80-71, <br />APPROVING SAID VARIANCE AND GRANTING <br />APPEAL NO. 445, FOR PROPERTY LOCATED <br />AT 1420 WEST FIFTH STREET <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council of the City of Santa Ana on July 20, 1981, on <br />the action taken by the Planning Commission in denying <br />Variance Application No. 80-71, which application seeks to <br />allow light manufacturing warehousing and open storage at <br />1420 West Fifth Street in the C1 District. <br /> <br /> WHEREAS, prior to taking action on said <br />Conditional Use Permit Application, this Council has <br />reviewed and considered the Negative Declaration for the <br />project, including Initial Study NO. IS-80-248; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby reverse the action of the Planning <br />Commission denying said Variance Application No. 80-71, and <br />does hereby approve said Variance and grant Appeal NO. 445. <br /> <br /> 2. That the City Council hereby adopts, as its <br />findings of fact for the approval of Variance No. 80-71, the <br />following: <br /> <br />(a) Special circumstances applicable to the <br />subject property exist in that the property <br />has long been used for manufacturing-related <br />uses. <br /> <br />(b) The property owner's right to obtain <br />maximum use of his property consistent with <br />the purpose and intent of the zoning regu- <br />lations is preserved by the granting of <br />this Variance. <br /> <br />(c) The subject use will not have a signif- <br />icant adverse effect on property in the <br />vicinity, due to the circumstances of its <br />location and surroundings. <br /> <br />(d) The subject use will not have a signif- <br />icant adverse effect on the future development <br />of the surrounding area in accordance with <br />the General Plan of the City. <br /> <br /> 3. For the reasons set forth in the Negative <br />Declaration prepared for this project, the Council approves <br />and adopts the said Negative Declaration and its finding <br />that the project will not have a significant effect on the <br />environment. <br /> <br /> <br />
