RE L: ad g <br />8/7/81 <br /> <br />RESOLUTION NO. 81-130 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA REVERSING THE ACTION <br />OF THE PLANNING COMMISSION ON CONDITIONAL <br />USE PERMIT APPLICATION NO. 80-22, APPROVING <br />SAID CONDITIONAL USE PERMIT, AND GRANTING <br />APPEAL NO. 448 FOR PROPERTY LOCATED AT <br />1222 EAST FIRST STREET <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council of the City of Santa Ana on August 3, 1981, on <br />the action taken by the Planning Commission in denying <br />Conditional Use Permit Application No. 80-22, which <br />application seeks to allow modification of an existing <br />service station to include a retail market at 1222 East <br />First Street in the M1 District; and <br /> <br /> WHEREAS, prior to taking action on said <br />Conditional Use Permit Application, this Council has <br />reviewed and considered the Negative Declaration for <br />project, including Initial Study No. IS-80-230; <br /> <br />the <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby reverse the action of the Planning <br />Commission denying said Conditional Use Permit Application <br />No. 80-22, and does hereby approve said Conditional Use <br />Permit and grant Appeal No. 448. <br /> <br /> 2. That the City Council hereby adopts, as its <br />findings of fact for the approval of Conditional Use Permit <br />No. 80-22, the following: <br /> <br />(a) The subject use provides a desirable <br />service to the neighborhood. <br /> <br />(b) The subject use will not have a <br />significant adverse effect on persons or <br />property in the vicinity, due to the cir- <br />cumstances of its location and surroundings. <br /> <br />(c) The subject use will be in compliance <br />with all relevant zoning regulations and <br />conditions. <br /> <br />(d) The subject use will not have a sig- <br />nificant adverse effect on the future <br />development of the surrounding area in <br />accordance with the General Plan of the City. <br /> <br /> 3. For the reasons set forth in the Negative <br />Declaration prepared for this project, the Council approves <br />and adopts the said Negative Declaration and its finding <br />that the project will not have a significant effect on the <br />environment. <br /> <br /> 4. The said Conditional Use Permit is approved <br />subject to the requirements and conditions set forth as <br />recommended requirements in that certain "Finding of Fact, <br /> <br /> <br />
