REL:adg <br />8/7/81 <br /> <br />RESOLUTION NO. 81- 131. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA OVERRULING THE ZONING <br />ADMINISTRATOR'S DENIAL OF MINOR EXECEPTION <br />APPLICATION 80-47, GRANTING APPEAL NO. 449 <br />AND APPROVING MINOR EXCEPTION NO. 80-47 <br />FOR PROPERTY LOCATED AT 1222 EAST FIRST STREET <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council on August 3, 1981, on the action taken by the <br />Zoning Administrator in denying Minor Exception Application <br />No. 80-47, which application seeks to allow sale of beer and <br />wine for off-site consumption in a proposed mini-market <br />within a service station at 1222 East First Street, in the <br />M1 District; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br />of the City of Santa Ana as follows: <br /> <br /> 1. That based on such public hearing and the <br />oral and documentary evidence submitted therein, the City <br />Council does hereby reverse the action of the Zoning <br />Administrator, grant Appeal No. 449, and approve Minor <br />Exception No. 80-47. <br /> <br /> 2. That the City Council adopts as its findings <br />of fact and conditions of approval for the approval of the <br />said Minor Exception that certain report entitled "Finding <br />of Fact, Minor Exception 80-47," submitted by the Zoning <br />Administrator and on file in the office of the Clerk of the <br />Council with the exception that "Reason for Decision" (a) <br />therein is amended to read as follows: <br /> <br />"The proposed use is desirable as <br />contributing to the general well-being <br />of the neighborhood, as existing establish- <br />ments in the area do not make up a very <br />heavy concentration of liquor licenses." <br /> <br />and "Reason for Decision" (b) therein is amended to read as <br />follows~ <br /> <br />"The surrounding area is such that <br />the proposed use will not be detrimental <br />to the health, safety, or general welfare <br />of persons or injurious to property or <br />improvements." <br /> <br /> ADOPTED this 17th .day of <br />1981, by the following vote: <br /> <br />Auqus t <br /> <br />AYES: <br /> <br />NOES: <br /> <br />COUNCILMEMBERS: Acosta, Bricken, Griset, <br /> Luxembourger, Markel, Serrato <br />COUNCISMEMBERS: McGuigan <br /> <br />ABSENT: COUNC ILMEMBERS: None <br /> <br />ATTEST: <br /> <br />APPROVED AS TO FORM: <br /> <br />EDWARD J. -CoOP .R ) <br />CITY ATTORNEY ~_w <br /> <br />/~MARDON BRICKEN <br /> YOR <br /> <br /> <br />
