RJW/fm 8/25/81 RESOLUTION NO. 81-144 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA VACATING A PUBLIC ALLEY GENERALLY LOCATED BETWEEN GARNSEY AND PARTON STREETS IN THE CITY OF SANTA ANA, CALIFORNIA; DESCRIBING SAID ALLEY; AND DIRECTING THE CLERK OF THE COUNCIL TO CAUSE A CERTIFIED COPY OF THIS RESOLUTION TO BE RECORDED IN THE OFFICE OF THE COUNTY RECORDER OF THE COUNTY OF ORANGE WHEREAS, the City Council of the City of Santa Ana has read and considered a report dated August 21, 1981, prepared by the Director of Public Works, recommending that a public alley, generally located between Garnsey and Parton Streets in the City of Santa Ana, and more particularly described in Exhibit "A," attached hereto and incorporated by reference, be vacated; and WHEREAS, pursuant to and in accordance with the provisions and Articles 1 and 2, pertaining to summary vacations, of Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, this Council finds from all the evidence submitted that the said alley, as described in the said Exhibit "A," is unnecessary for present or prospective public use, based upon the following findings of fact: 1. That said alley, for a period of five (5) consecutive years, has been impassable for vehicular use; and 2. That said alley, for a period of five (5) consecutive years, has not been the subject of the expenditure of public monies for the maintenance thereof. WHEREAS, pursuant to the provisions of ~ 2381 of Chapter 8 of Division 3 of the Streets and Highways Code of the State of California, the City Council does hereby find and determine that neither said alley, nor any part or portion thereof, is useful as a nonmotorized transportation facility, as defined in § 156 of said code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: That this Council does hereby order that that certain public alley, generally located between Garnsey and Parton Streets in the City of Santa Aha, more fully described in Exhibit "A," attached hereto and made a part hereby of this reference, be, and the same is, hereby vacated.
