REL:jd <br />9/10/81 <br /> <br />RESOLUTION NO. 81-148 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA OVERRULING THE ZONING <br />ADMINISTRATOR'S DENIAL OF MINOR EXCEPTION <br />APPLICATION 81-27, GRANTING APPEAL NO. <br />454 AND APPROVING MINOR EXCEPTION NO. 81-27 <br />FOR PROPERTY LOCATED AT 414 NORTH EUCLID <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council on September 8, 1981, on the action taken by the <br />Zoning Administrator in denying Minor Exception Application <br />No. 81-27, which application seeks to allow sale of beer and <br />wine for on and off-site comsumption in an existing restaurant- <br />meat market at 414 North Euclid Street, in the C1 District; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and the oral <br />and documentary evidence submitted therein, the City Council <br />does hereby reverse the action of the Zoning Administrator, <br />grant Appeal No. 454, and approve Minor Exception No. 81-27. <br /> <br /> 2. That the City Council adopts as its findings <br />of fact and conditions of approval for the approval of the <br />said Minor Exception that certain report entitled "Finding of <br />Fact, Minor Exception 81-27,: submitted by the Zoning Admin- <br />istrator and on file in the office of the Clerk of the Council <br />with the exception that "Reason for Decision" (a) therein is <br />amended to read as follows: <br /> <br />"The proposed use is desirable as con- <br />tributing to the general well-being of <br />the neighborhood, as existing establish- <br />ments in the area do not make up a very <br />heavy concentration of liquor licenses." <br /> <br />and "Reason for Decision" (b) therein is amended to read as <br />follows: <br /> <br />"The surrounding area is such that the <br />proposed use will not be detrimental to <br />the health, safety, or general welfare <br />of persons or injurious to property or <br />improvements. <br /> <br /> ADOPTED this 215t day of September <br />the following vote: <br /> <br />, 1981, by <br /> <br />AYES: <br /> <br />NOES: <br /> <br />COUNCILMEMBERS: Acosta, Griset, Luxemb0urger, <br /> McGuigan, Serrato <br />COUNCILMEMBERS: Bricken, Markel <br /> <br />ABSENT: <br /> <br />COUNCILMEMBERS: None <br /> <br />ATTEST: <br /> <br />~ERK OF THE coUN~ <br /> APPROVED AS TO FORM: <br /> <br /> E UWARD J. <br /> CITY ATTORIqEY <br /> <br /> <br />
