REL:ar <br />9/10/81 <br /> <br />RESOLUTION NO. 81-154 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA REVERSING THE ACTION OF THE PLANNING <br /> COMMISSION ON VARIANCE APPLICATION NO. 81-12, <br />APPROVING SAID VARIANCE, AND GRANTING APPEAL NO. <br />451, FOR PROPERTY LOCATED AT 510 FAIRHAVEN AVENUE <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council of the City of Santa Ana on September 8, 1981, <br />on the action taken by the Planning Commission in denying <br />Variance Application No. 81-12, which application seeks to <br />waive minimum homesite area requirements, a portion of the <br />required parking, trash enclosures and a common storage area <br />for the development of a mobile home park (which application <br />was modified by the applicant to seek only waiver of trash <br />enclosure and common storage area requirements) at 510 Fair- <br />haven Avenue in the A1 District. <br /> <br /> WHEREAS, prior to taking action on said Variance <br />Application, this Council has reviewed and considered the <br />Negative Declaration for the project, including Initial <br />Study No. IS 81-46. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and the oral <br />and documentary evidence submitted therein, the City Council <br />does hereby reverse the action of the Planning Commission <br />denying said Variance Application NO. 81-12, and does hereby <br />approve said Variance and grant Appeal No. 451, insofar as <br />the same pertains to waiver of trash enclosure and common <br />storage area requirements. <br /> <br /> 2. That the City Council hereby adopts as its <br />findings of fact for the approval of Variance No. 81-12, the <br />following: <br /> <br /> (b) Special circumstances apply to the <br />subject property which justify the waiver of <br />requirements for trash enclosures and a common <br />storage area, in that the project is designed for <br />individual unit trash collection and storage in <br />the same manner as conventional single family homes, <br />and the strict application of such requirements <br />would deprive the subject property of amenities <br />such as open space without any corresponding benefit. <br /> <br /> (b) The granting of this variance is <br />necessary to preserve the owner's right to develop <br />his property in a manner consistent with the <br />purpose and intent of the zoning regulations, in <br />that requiring the installation of trash enclosures <br />and a common storage area would impose an unreason- <br />able burden on development of the property. <br /> <br /> <br />
