RESOLUTION NO. 81-179 <br /> <br />RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA REDUCING THE ASSESS- <br />MENTS HERETOFORE CONFIRMED WITHIN <br />ASSESSMENT DISTRICT NO. 246 <br /> <br /> WHEREAS, this City Council, by its Resolution No. <br />81-141 adopted on September 21, 1981, confirmed the assess- <br />ments levied within Assessment District No. 246, ordered <br />certain improvements to be made, and designated the City <br />Treasurer to collect the assessments; and <br /> <br /> WHEREAS, subsequent to the confirmation, a bid for the <br />construction of the improvements so ordered has been re- <br />ceived in an amount less than previously estimated; and <br /> <br /> WHEREAS, also subsequent to the confirmation, a bid <br />for the purchase of the bonds to be issued pursuant to the <br />Improvement Bond Act of 1915 to represent the unpaid assess- <br />ment has been received in an amount less than previously <br />estimated; and <br /> <br /> WHEREAS, as a result of these cost decreases it is <br />necessary to reduce the amount of all assessments previously <br />confirmed to accurately reflect the cost of the improvements <br />so ordered; and <br /> <br /> WHEREAS, there has been submitted to the City Council a <br />revised Engineer's Report setting forth the reduced assess- <br />ments; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY <br />COUNCIL OF THE CITY OF SANTA ANA, STATE OF CALIFORNIA, as <br />follows: <br /> <br /> 1. The City Council hereby reduces the assessments to <br />the amounts set forth in the Engineer's Report, as revised. <br /> <br /> 2. The City Clerk shall transmit to the Superinten- <br />dent of Streets of the City of Santa Ana the reduced Assess- <br />ment, and the Superintendent is hereby directed to record <br />the reduced Assessment in a substantial book kept for <br />that purpose in his office. <br /> <br /> 3. The City Treasurer is hereby authorized and <br />directed to return to any assessees who paid assessments <br />against their property subsequent to confirmation of the <br />initial Assessment, the amount which is in excess of the <br />assessments confirmed herein. <br /> <br /> 4. The City Treasurer is further directed to set <br />forth in the "List of Unpaid Assessments" the revised <br />assessments confirmed herein. <br /> <br /> <br />
