RESOLUTION NO. 82-33 <br /> <br />RESOLUTION OF THE CITY COUNCIL ORDERING <br />CERTAIN CHANGES AND MODIFICATIONS TO THE <br />ENGINEER'S "REPORT" IN A SPECIAL ASSESSMENT <br />DISTRICT <br /> <br />WHEREAS, the CITY COUNCIL of CITY OF SANTA ANA, CALIFORNIA (hereinafter <br />referred to as "Agency") has previously adopted its Resolution of Intention <br />pursuant to the provisions of the "Municipal Improvement Act of 1913", being <br />Division 12 of the Streets and Highways Code of the State of California, for <br />the construction of certain works of improvement in a special assessment <br />district known and designated as <br /> <br />ASSESSMENT DISTRICT NO. 245 <br /> <br />(hereinafter referred to as the "Assessment District"); and <br /> <br />WHEREAS, subsequent thereto, this Agency did, by Resolution, approve the <br />"Report" and call for sealed bids on the construction of the works of <br />improvement as contemplated in said Assessment District; and, <br /> <br />WHEREAS, prior to said Public Hearing, sealed bids were received and <br />considered for the construction of the works of improvement in the Assessment <br />District, and at this time an amended assessment roll has been presented <br />showing modifications and reductions in all assessments because of the <br />favorable construction bid so received; and, <br /> <br />WHEREAS, it now appears to this Agency that the changes and modifications as <br />set forth in the amended assessment roll as presented herein should be approved <br />and ordered by this Agency. <br /> <br />NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: <br /> <br />SECTION 1. That the above recitals are all true and correct. <br /> <br />SECTION 2. <br /> <br />That it is hereby ordered that the changes and modifications as <br />set forth in the amended assessment roll as presented herein, <br />based on the construction bids received, are hereby ordered to be <br />done and approved by this Agency. <br /> <br />SECTION 3. <br /> <br /> That said changes and modifications above mentioned are hereby <br />ordered pursuant to the authority as set forth in Section 10352 of <br />the Streets and Highways Code of the State of California (the <br />"Municipal Improvement Act of 1913"). <br /> <br /> <br />
