REL:adg <br />9/8/82 <br /> <br />RESOLUTION NO. 82-130 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA OPPOSING S.2172 <br />"CABLE TELECOMMUNICATION ACT OF 1982" <br /> <br /> WHEREAS, local governments are best equipped to <br />regulate cable systems throughout the franchise process; and <br /> <br /> WHEREAS, the regulator requirements and services <br />provided by cable systems are most appropriately determined <br />by negotiations at the local level; and <br /> <br /> WHEREAS, the Federal Communications Commission <br />does not have the capacity to regulate thousands of local <br />cable systems; and S.2172 proposes extensive involvement of <br />the Federal Communications Commission in the regulation of <br />the cable systems; and <br /> <br /> WHEREAS, the cable industry has not made an <br />effective case for overhauling the existing regulatory <br />system; and <br /> <br /> WHEREAS, prohibiting cities from establishing <br />franchise requirements that are different from or <br />inconsistent with Federal requirements, effectively prevents <br />cities from bringing the benefits of competition to their <br />residents; and <br /> <br /> WHEREAS, providing cable operators with a <br />preference in franchise renewal proceedings in anti- <br />competitive; and <br /> <br /> WHEREAS, S.2172 limits the ability of cities to <br />insure diversity of information through locally developed <br />rate regulations and service requirements. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City <br />Council of the City of Santa Ana does hereby oppose S.2172, <br /> <br /> <br />
