RESOLUTION NO. 82- 134 <br /> <br />REL:adg <br />9/24/82 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA APPROVING <br />VARIANCE NO. 82-10 TO MODIFY THE <br />REAR YARD SETBACK REQUIREMENT FOR <br />PROPERTY LOCATED AT 1719 WEST <br /> ~DINGER AVENUE IN THE A1 DISTRICT <br /> <br />September 20, <br />application sou~ <br />lights as <br />and yard setback <br />Agricultural) use <br />Edinger Avenue and <br />Exhibit <br /> <br /> , this Council held a public hearing on <br /> on Variance Application No. 82-10, which <br /> to allow 49-foot high athletic field <br /> structures at variance with the height <br /> ' ~ements of the A1 (General <br /> trict on property located at 1710 West <br /> on the map attached hereto as <br />A, and incor ted herein by reference; and <br /> <br /> WHEREAS, prior ~taking action on the said <br />application, this council h~s reviewed the negative <br />declaration (I.S. No.82-69) ~repared for the project; <br /> <br /> NOW, THEREFORE, BE IT~,RESOLVED AS FOLLOWS: <br /> <br /> 1. Based on the evidence s~bmitted at the abovesaid <br />hearing this Council finds and det~mines as follows: <br /> <br /> (a) The strict application\of the rear yard <br />setback requirement of the A1 district~ould deprive the <br />subject property of privileges not othe~ise at variance <br />w~th the intent and pur. pose of said z.onin~, requirements, <br />s~nce, due to the conditions imposed herei~below, the <br />reduction of such setback from 25 feet to l~feet will not <br />adversely impact neighboring property.- \~ <br /> (b) There are no special circumstan~s applicable <br />to the subject property justifying waiver of thex~height and <br />side yard setback requirements of the A1 Distric~ <br /> (c) The modification of the rear yar~ setback <br />requirement is necessary to allow reasonable evening~use of <br />the athletic field on the subject property. <br /> <br /> (d) Due to the conditions imposed hereinbelo~, a <br />variance from the rear yard setback requirement will not be <br />materially detrimental to the public welfare or injurious'~to <br />surrounding property, since the adverse light and glare an~ <br />aesthetic effects of the field lights will be mitigated to~ <br />an insignificant level. <br /> <br /> <br />
