RESOLUTION NO. 83-36 <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA VACATING PORTIONS OF <br />EIGHTH STREET LOCATED BETWEEN EUCLID <br />STREET AND ROSITA STREET <br />REL:adg <br />2/23/83 <br />'� pl"131 <br />1 1 1 <br />•err— Mow <br />� <br />WHEREAS, prior to the annexation by the City of <br />Santa Ana of the area bounded by Euclid Street, Hazard <br />Avenue, Rosita Street and Seventh Street, certain portions <br />of said area had been dedicated for a proposed extension of <br />Eighth Street between Euclid Street and Rosita Street, which <br />dedicated portions are specifically described in Exhibit A, <br />attached hereto and incorporated herein; and <br />WHEREAS, this Council finds and determines that, <br />due to the incomplete,°fragmented and scattered nature of <br />the dedications for the abovesaid proposed extension of <br />Eighth Street and the total lack of street improvements <br />therein: <br />(a) For a period of more than five consecutive <br />years, said dedicated portions of Eighth Street have been <br />impassable for vehicular traffic; and <br />(b) No public money has been expended for <br />maintenance on said dedicated portions of Eighth Street <br />during such period; and <br />WHEREAS, this Council also finds and determines <br />that said dedicated portions of Eighth Street are <br />unnecessary for present or prospective public use, for the <br />following reasons: <br />(a) Due to private developments constructed in or <br />approved for the area, there is no realistic possibility of <br />completing the dedication and improvement of Eighth Street <br />between Euclid Street and Rosita Street. <br />(b) The vacation of the said dedicated portions <br />of Eighth Street will not affect the access rights of <br />abutting property owners, since such dedicated portions do <br />not in fact provide any effective means of access; and <br />WHEREAS, pursuant to the provisions of 5 2381 of <br />the Streets and Highways Code of the State of California, <br />this Council does find and determine that no part of the <br />abovesaid dedicated portions of Eighth Street are useful as <br />a nonmotorized transportation facility, as defined in § 156 <br />of said Code; and <br />
