3/88 EXHIBIT A NOT ATTACHED TO RESOLUTION <br />RESOLUTION NO. 83- 125 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA APPROVING MINOR EXCEPTION NO. <br />83-31 TO WAIVE 20 PERCENT OF THE FRONT YARD <br />SETBACK REQUIREMENT FOR PROPERTY LOCATED AT <br />714 EAST PARK LANE IN THE R1 USE DISTRICT <br />REL:adg <br />10/14/83 <br />WHEREAS, this Council held a public hearing on October 10, <br />1983, a Minor Exception Application No. 83-31, to allow waiver <br />of 20 percent of the required front yard setback for property <br />located at 714 East Park Lane in the R1 use district, and shown <br />on the map attached hereto as Exhibit A, and incorporated herein <br />by reference; and <br />WHEREAS, prior to taking action on the said application, <br />this Council has reviewed the negative declaration (I.S. No. 83- <br />89) prepared for the project; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br />1. Based on the evidence submitted at the abovesaid hear- <br />ing, this Council finds and determines as follows: <br />(a) The subject residence is an older tract home in <br />need of the expansion of living space. Expansion to the rear is <br />not feasible. This constitutes special circumstances justifying <br />a minor exception from the setback requirement. <br />(b) The granting of this minor modification is nec- <br />essary to preserve the right to use and improve the subject <br />property in a manner consistent with the spirit and intent of the <br />zoning ordinances. <br />(c) The granting of this minor exception will not have <br />any adverse effect on surrounding property or the public welfare. <br />(d) The granting of this minor exception will not <br />adversely affect the City's general plan. <br />(e) For the reasons set forth in the Initial Study <br />No. 83-89, the negative declaration prepared for this project, <br />with its finding that the project will not have a significant <br />effect on the environment, is hereby approved. <br />
