REL:adg <br />5/9/84 <br /> <br />RESOLUTION NO. 84-57 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA APROVING MINOR EXCEPTION NO. 84-5 <br />TO ALLOW THE SALE OF BEER AND WINE FOR ON-SITE <br />CONSUMPTION ON PROPERTY LOCATED AT 3522 WEST <br />FIRST STREET <br /> <br /> WHEREAS, this Council held a public hearing on <br />May 7, 1984, on Minor Exception Application No. 84-5, to <br />allow the sale of beer and wine in a restaurant on property <br />located at 3522 West First Street in the C2 District; and <br /> <br /> WHEREAS, prior to taking action on the said applica- <br />tion, this Council has reviewed the negative declaration <br />prepared for the project; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS= <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br /> (a) The sale of beer and wine for on-site consumption <br />is a service which is commonly provided by restaurants and ex- <br />pected by their guests. This minor exception is therefore <br />desirable to provide a service which will contribute to the <br />general well-being of the community by promoting public con- <br />venience. <br /> <br /> (b) The provision of beer and wine for sale for on- <br />site consumption in the restaurant will not create any excessive <br />concentration of establishments selling alcoholic beverages <br />in the vicinity and will not adversely impact the crime rate in <br />the vicinity or otherwise create any nuisance to nearby residents <br />and businesses. Therefore, this minor exception will not be detri- <br />mental to the health, safety or general welfare of persons residing <br />or working in the vicinity, or injurious to property or improvements <br />in the vicinity. <br /> <br /> (c) The sale of beer and wine for on-site consumption <br />at the restaurant pursuant to this minor exception will not <br />violate any regulations or ~conditions of the zoning chapter of <br />the municipal code nor adversely affect the general plan of the <br />city. <br /> <br /> <br />
