REL:adg <br />6/6/84 <br /> <br />RESOLUTION NO. 84-69 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA APROVING MINOR EXCEPTION NO. 84-8 <br />TO ALLOW THE SALE OF BEER AND WINE FOR ON-SITE <br />CONSUMPTION ON PROPERTY LOCATED AT 4419-4421 <br />WEST FIRST STREET <br /> <br /> WHEREAS, this Council held a public hearing on <br />June 4, 1984, on Minor Exception Application No. 84-8, to <br />allow the sale of beer and wine in an existing restaurant <br />located on property located at 4419-4421 West First Street <br />in the C2 District; and <br /> <br />tion, <br />(I.S. <br /> <br /> WHEREAS, prior to taking action on the said applica- <br />this Council has reviewed the negative declaration <br />84-27) prepared for the project; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br /> (a) The sale of beer and wine for on-site con- <br />sumption is a service which is commonly provided by <br />restaurants and expected by their customers. This minor <br />exception is therefore desirable to provide a service which <br />will contribute to the general well-being of the community. <br /> <br /> (b) The provision of beer and wine for sale for on- <br />site consumption in the restaurant will not create any excessive <br />concentration of establishments selling alcoholic beverages in <br />the vicinity and will not adversely impact the crime rate in <br />the vicinity or otherwise create any nuisance to nearby <br />residents and businesses. Therefore, this minor exception <br />will not be detrimental to the health, safety or general wel- <br />fare of persons residing or working in the vicinity. <br /> <br /> (c) The sale of beer and wine for on-site consumption <br />at the restaurant pursuant to this minor exception will not <br />violate any regulations or conditions of the zoning chapter of <br />the municipal code nor adversely affect the general plan of the <br />city. <br /> <br /> <br />
