REL:adg <br />8/8/84 <br /> <br />RESOLUTION NO. 84- 97 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA APROVING MINOR EXCEPTION NO. 84-19 <br />TO ALLOW THE SALE OF BEER AND WINE FOR OFF-SITE <br />CONSUMPTION ON PROPERTY LOCATED AT 1134 WEST <br />FIRST STREET <br /> <br /> WHEREAS, this Council held a public hearing on <br />August 6, 1984, on Minor Exception Application No. 84-19, <br />to allow the sale of beer and wine in an existing mini-market <br />located on property located at 1134 West First Street in the <br />C1 District; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br /> (a) The sale of beer and wine in package form for <br />off-site consumption is a service which is commonly provided by <br />neighborhood convenience markets and expected by their <br />customers. This minor exception is therefore desirable to <br />provide a service which will contribute to the general well- <br />being of the community by promoting shopping convenience. <br /> <br /> (b) The provision of beer and wine for sale for off- <br />site consumption in the neighborhood convenience market will not <br />create any excessive concentration of establishments selling <br />alcoholic beverages in the vicinity and will not adversely impact <br />the crime rate in the vicinity or otherwise create any nuisance <br />to nearby residents and businesses. Therefore, this minor exception <br />will not be detrimental to the health, safety or general welfare <br />of persons residing or working in the vicinity, or injurious to <br />property or improvements in the vicinity. <br /> <br /> (c) The sale of beer and wine for off-site consumption <br />at the market pursuant to this minor exception will not violate <br />any regulations or conditions of the zoning chapter of the munici- <br />pal code nor adversely affect the general plan of the city. <br />city. <br /> <br /> <br />
