V ..................... ~EL:3d (26) <br /> 1/22/86- <br /> <br />RESOLUTION NO. 86-8 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA DENYING CONDITIONAL USE PERMIT <br />APPLICATION NO. 84-19 TO ALLOW THE SALE OF <br />ALCOHOLIC BEVERAGES IN A MINI-MARKET IN THE <br />C2 DISTRICT AT 2501 WEST SEVENTEENTH STREET <br /> <br /> WHEREAS, the City Council held a public hearing on <br />January 20, 1986 on Conditional Use Permit 84-19 to allow the <br />sale of alcoholic beverages in a mini-market in the C2 District <br />on property located at 2501 West Seventeenth Street, which ap- <br />lication was brought before this Council by Appeal No. 533 fol- <br />lowing its denial by the Planning Commission; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br /> (a) The proposed use will not enhance the indi- <br />vidual identity of this neighborhood or improve the quality of <br />life, public safety or general well being. There are presently <br />seven businesses licensed to sell alcoholic beverages within 500 <br />feet of the subject property. Approval of the conditional use <br />permit request would result in an over-concentration of off-sale <br />establishments within the immediate area of the proposed use. <br /> <br /> (b) The proposed use will be detrimental to the <br />health, safety and General welfare of persons residing or working <br />in the vicinity in that the basic needs for off-sale of all types <br />of alcoholic beverages are served by a variety of existing markets <br />located in this area. The introduction of additional off-sale <br />establishments will not contribute to the general welfare of <br />persons residing in the immediate surrounding area. <br /> <br /> (c) The requested use of the subject property to <br />include additional retail sales and off-sale beer and wine will <br />increase the already intense use of the site. Addition of the <br />proposed use to the property in its present condition will have <br />an adverse impact on the site as well as the surrounding proper- <br />ties. <br /> <br /> (d) The existing use of the service station is <br />nonconforming because parking and landscaping do not meet Code. <br /> <br /> <br />
