-- 135 <br /> <br />REL :k-1 <br />04/23/86 <br /> <br />RESOLUTION NO. 86- ~ <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DENYING CONDITIONAL USE PERMIT APPLI- <br />CATION NO. 86-3 TO ALLOW SALE OF ALCOHOLIC <br />BEVERAGES AT A PROPOSED MINI-M~RK~T AT 1055-~ ' <br />WEST FIRST STREET. <br /> <br /> WHEREAS, the C~ty Council held a public hearing on April 21, <br />1986 on Conditional Use Permit Application No. 86-3 to allow the <br />sale of alcoholic beverages at a proposed mini-market at 1055-A <br />West First Street, which application was brought before this <br />Council by Appeal No. 537 following its denial by the Planning <br />Commission; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the abovesaid hearing <br />this Council finds and determines as follows: <br /> <br /> (a) The proposed use will not enhance the individual <br />identity to this neighborhood or improve the quality of life, <br />public safety or general well being. Approval of the conditional <br />use permit request would result in an over-concentration of off- <br />sale establishments within the immediate area of the proposed use. <br /> <br /> (b) The proposed use will be detrimental to the health, <br />safety and general welfare of persons residing or working in the <br />vicinity in that the basic needs for off-sale of all types of <br />alcoholic beverages are served by a variety of existing markets <br />located in this area. The introduction of additional off-sale <br />establishments will not contribute to the general welfare of <br />persons residing in the immediate surrounding area. <br /> <br /> (c) The proposed use will adversely affect the stability <br />of the area in that an over-concentration of businesses selling <br />alcoholic beverages does not afford the area an economically <br />balanced retail climate needed to sustain this mixed commercial area. <br /> <br />2. Conditional Use Permit Application No. 85-34 is hereby <br />denied. <br /> <br /> <br />
