191 <br /> <br />REL :k-5 <br />06/04/86 <br /> <br />RESOLUTION NO. 86-~ <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. <br />86-5 TO ALLOW SALE OF BEER AND WINE IN A RETAIL <br />ESTABLISHMENT OF LESS THAN 3000 SQUARE FEET ON <br />PROPERTY LOCATED AT 4201 WEST FIRST STREET. <br /> <br /> WHEREAS, this council held a public hearing on May 19, <br />1986 on Conditional Use Permit Application No. 86-5 to allow <br />sale of beer and wine in a retail establishment of less than <br />3000 square feet on property located at 4201 West First <br />Street, said application having come before this Council by <br />Appeal No. 540 following its denial by the Planning Commission; <br />and <br /> <br /> WHEREAS, prior to taking action on the said application, <br />this Council reviewed and approved the negative declaration <br />prepared for the project; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing, this Council finds and determines as follows: <br /> <br /> (a) The proposed use will provide the community <br />with a business establishment providing a convenience to consumers. <br /> <br /> (b) The use, as proposed, would not be detrimental <br />to the health, safety and general welfare of the persons <br />residing or working in the area. The intent of the owners is <br />to operate a store providing off-site consumption sales with <br />no on-site consumption occuring at this site. <br /> <br /> (c) The site, as designed, is a beneficial influence <br />to the economic stability of the community. <br /> <br /> (d) The project, as proposed, complies with the <br />zoning regulations and specifications for such use. <br /> <br /> (e) The project, as proposed, will not adversely <br />affect the General Plan designation applicable to this site. <br /> <br /> <br />
