REL:jd(24) <br />**** REPEALED BY RES. 87-60***** 6/23/86 <br /> <br />RESOLUTION NO. 86-81 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA ESTABLISHING FEES FOR THE ADMINISTRATION <br />OF THE HAZARDOUS MATERIALS RELEASE RESPONSE PLANS <br />AND INVENTORY LAW <br /> <br /> WHEREAS, pursuant to Chapter 6.95 (commencing with Sec- <br />tion 25500) of Division 20 of the Health and Safety Code of the <br />State of California, businesses which handle hazardous materials <br />must submit emergency response plans and annual inventories of <br />hazardous materials to the local enforcing agency; and <br /> <br /> WHEREAS, under Section 18-2 of the Santa Ana Municipal <br />Code, the City of Santa Ana assumes responsibility for the imple- <br />mentation of said state law; and <br /> <br /> WHEREAS, pursuant to Section 25513 of said state law, <br />the City Council is authorized to adopt a schedule of fees to be <br />collected from those business which are required to submit plans <br />in an amount sufficient to pay the costs incurred by the city <br />in carrying out the provisions of said state law; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Santa Ana as follows: <br /> <br />1. Business plans <br /> <br /> (a) Each submission of a business plan (as defined <br />in Health and Safety Code Section 25501) and each certification <br />provided pursuant to Health and Safety Code Section 25505(c) shall <br />be accompanied by a fee based upon the "quantity range" of the <br />subject business in accordance with the following schedule: <br /> <br />Quantity Range <br /> <br />Fee <br /> <br />1 $157.00 <br /> <br />2 $193.00 <br /> <br />3 $230.00 <br /> <br /> (b) "Quantity range" refers to the maximum quantity <br />of all hazardous materials present on the business premises at any <br />one time. The three quantity ranges are identified as follows: <br /> <br />Unit of Measurement <br /> <br />Quantity Range <br /> <br />Gallons Cubic Feet Pounds <br /> <br />55-1,000 200-1,000 50-1,000 <br /> <br />2 <br /> <br />1,001-10,000 1,001-5,000 1,001-5,000 <br /> <br />3 <br /> <br />over 10,000 over 5,000 over 5,000 <br /> <br /> <br />
