REL: adg <br />8/21/85 <br /> <br />RESOLUTION NO. 85-106 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CiTY OF SANTA ANA APPROVING VARIANCE NO. <br />85-12 TO ALLOw AN OFF-PREMiSE ADVERTISING <br />SIGN ON PROPERTY LOCATED AT 3020-3022 <br />HESPERIAN STREET <br /> <br /> WHEREAS, this Council held a public hearing on <br />August 19, 1985 on'Variance Application No. 85-12, to allow <br />an off-premise advertising sign at 3020-3022 Hesperian Street <br />at ~variance with the location, height and size restrictions <br />of the zoning regulations; and <br /> <br /> WHEREAS, prior to taking action bn the said applica- <br />tions, this Council has reviewed and approved the negative <br />declaration (I.S. No. 85-82) prepared for the project; <br /> <br /> NOW, ~HEREFoRE~ BE IT RESOLVED ~Y THE CItY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1.- -~ased upon the evidence submitted aG the abovesaid <br />hearing, this Council finds and determines as follows: <br /> <br /> (a) The. s~rict application of the zoning ordinance's <br />restrictions on height,.size and location would deprive <br />the subject property of privileges not otherwise at <br />variance with the intent and purpose of the said ordin- <br />ance, due to the special circumstances of the subject <br />property's location and surroundings. <br /> <br /> (b) The approval of the subject variance is <br />necessary to preserve the right of the owner of the <br />subject property to preserve and enjoy a substantial <br />property right. <br /> <br /> (c) The subject sign will not have a, significant <br />adverse effect on persons or property in the vicinity, <br />due to the circumstances of its location and surround- <br />ings and the conditions of approval hereinbelow. <br /> <br /> <br />
