REL: adg <br />8/21/85 <br /> <br />RESOLUTION NO. 85-108 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA DENYING CONDITIONAL <br />USE PERMIT APPLICATION NO. 85-27 TO <br />ALLOW A CHURCH IN THE R1 DISTRICT AT <br />5009 WEST FIFTH STREET <br /> <br /> WHEREAS~ the City Council held a public hearing on <br />August 19, 1985 on Conditional Use Permit No. 85-27 to allow <br />a church in the R1 District on property located at 5009 West <br />Fifth Street, which application was brought before this Council <br />by Appeal No. 528 following its denial by the Planning Commis- <br />sion; <br /> <br />OF THE <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the abovesaid <br />hearing, this Council finds and determines as follows: <br /> <br /> (a} The proposed church will not contribute to <br />the general well being of this neighborhood because <br />the property and building were not designed to <br />accommodate the needs of a multi-purpose church <br />facility on a single-family residential size lot. <br /> <br /> (b) The proposed use will be detrimental to the <br />health, safety and general welfare of persons residing <br />and working in this neighborhood by creating additional <br />parking problems on public streets, increasing noise <br />levels in this residential community, and increasing <br />traffic. <br /> <br /> (c) The proposed use may affect the economic <br />stability of this residential neighborhood by nega- <br />tively impacting the surrounding residential property <br />owners with undue noise, parking intrusion and other <br />non-residential activity in the area. <br /> <br /> <br />
