RESOLUTION 85-133 <br /> <br />RESOLUTION OF THE CITY COUNCIL FINDING THE <br />PREMISES LOCATED AT 409 E. FIFTH STREET, <br />SANTA ANA, CALIFORNIA TO CONSTITUTE A PUBLIC <br />NUISANCE AS DEFINED IN SANTA ANA MUNICIPAL <br />CODE AND AUTHORIZING ABATEMENT OF SAME. <br /> <br /> WHEREAS, the City Council of the City of Santa Ana has <br />provided, in Chapter 17 of the Santa Ana Municipal Code, for the <br />abatement of a premise as a public nuisance; <br /> <br /> WHEREAS, as set forth in Section 17-23 of the Santa <br />Ana Municipal Code, a hearing for the existence of a public <br />nuisance at the premises located at 409 East Fifth Street, Santa <br />Ana, California, was held on October 10, 1985; <br /> <br /> WHEREAS, at the conclusion of the October 30, 1985, the <br />hearing officer found the following: <br /> <br /> 1. The conditions of the premises located at 409 East <br />Fifth Street, Santa Ana, constitute a public nuisance within the <br />meaning of Section 3479 of California Civil Code and as defined <br />in Section 17-1 of the Santa Ana Municipal Code; <br /> <br /> 2. The premises located at 409 East Fifth Street, <br />Santa Ana, have been damaged by fire and has become so <br />dilapidated as to become a harbor for vagrants, criminal or <br />immoral persons; <br /> <br />3. The building shall be abated by demolition. <br /> <br /> NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA: <br /> <br /> 1. The premises located at 409 East Fifth Street, <br />Santa Ana, and the conditions therein constitute a public <br />nuisance as defined in Section 3479 of the California Civil Code; <br /> <br /> 2. The premises has been damaged by fire and has <br />become so dilapidated as to become a harbor for vagrants, <br />criminal or immoral persons; <br /> <br /> 3. That the Community Preservation Officer of the City <br />of Santa Ana is hereby authorized and directed to abate the <br />conditions on the premises located at 409 East Fifth Street, <br />Santa Ana, by demolition not earlier than 60 days from the <br />adoption of this resolution; <br /> <br /> 4. The owner Ms. Sally Perrie shall have 30 days from <br />receipt of service of this resolution or 60 days from the date of <br />adoption of same, whichever is earlier, to abate the premises <br />located at 409 East Fifth Street, Santa Ana, by demolition; <br /> <br />1 <br /> <br /> <br />
