REL: adg-6 <br />11/20/85 <br /> <br />RESOLUTION NO. 85- 143 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA DENYING CONDITIONAL USE <br />PERMIT APPLICATION NO. 85-34 TO ALLOW THE <br />SALE OF ALCOHOLIC BEVERAGES IN A COMBINED <br />MARKET AND GAS STATION IN THE C1 DISTRICT <br />AT 1104 SOUTH BRISTOL STREET <br /> <br /> WHEREAS, the City Council held a public hearing on <br />November 18, 1985 on Conditional Use Permit No. 85-34 to allow <br />the sale of alcoholic beverages in a combined market and gas <br />station in the C1 District on property located at 1104 South <br />Bristol Street, which application was brought before this <br />Council by Appeal No. 532 following its denial by the Planning <br />Commission; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br /> (a) The proposed use will not enhance the individual <br />identity to this neighborhood or improve the quality of life, <br />public safety or general well being. There are presently 12 <br />businesses licensed to sell alcoholic beverages within 1,000 <br />feet of the subject property. Approval of the conditional use <br />permit request would result in an over-concentration of off- <br />sale establishments within the immediate area of the proposed <br />use. <br /> <br /> (b) The proposed use will be detrimental to the health, <br />safety and general welfare of persons residing or working in the <br />vicinity in that the basic needs for off-sale of all types of <br />alcoholic beverages are served by a variety of existing markets <br />located in this area. The introduction of additional off-sale <br />establishments will not contribute to the general welfare of <br />persons residing in the immediate surrounding area. <br /> <br /> (c) The proposed use will adversely affect the <br />stability of the area in that an over-concentration of businesses <br />selling alcoholic beverages does not afford the area an economic- <br />ally balanced retail climate needed to sustain this mixed commer- <br />cial area. <br /> <br /> <br />
