139 <br /> <br />07-0~A-055-7.85 <br /> <br />L A N D S C A P E M A I N T E N AN C,:E P R O V ~' S~T O N S <br /> <br />2(* <br /> <br />o <br /> <br />(, <br /> <br />10. <br /> <br />This permit by and between the State of California, acting by, <br />and through the Department of Transportation, hereinafter <br />referred to as "the State", and the City of Santa Ann, <br />hereinafter referred to as "the Permittee." <br /> <br />All landscape maintenance work is subject to Caltrans <br />approval and shall be done in accordance with State <br />Maintenance Manuals and current safety procedures, a copy of <br />which shall be made available upon request. <br /> <br />Permittee would maintain the roadside landscaping within the <br />limits shown under this permit. <br /> <br />Each request for maintenance access shall be subject to <br />approval of the State Permit Inspector. Permittee shall <br />notify State Permit Inspector a minimum of two (2) working <br />days prior to the start of any landscape maintenance work. <br /> <br />Damage to landscaping resulting from accident, storm, neglect <br />or other causes beyond the control of the.State is the <br />responsibility of the Permittee. <br /> <br />The State will maintain all highway signs, paved drainage <br />structures and other non-landscape highway appurtenance. <br /> <br />All planting will be maintained by the Permittee in such <br />condition that it does not interfere with the free flow of <br />traffic, including maintaining adequate site distances and <br />visibility of signs. Trees would be maintained to avoid <br />falling branches and to avoid obscuring advertising signs. <br /> <br />Permittee would provide and maintain all water and irrigation <br />systems including utility costs. Irrigation systems will be <br />maintained and operated to avoid slope damage and water <br />run-off or spray onto the pavement. <br /> <br />Landscape paving or other unplanted areas along the roadside <br />within the limits shown on the attached plans, exclusive of <br />paved, drainage facilities, will be maintained by the Permittee <br />Any graded drainage swales will be maintained so as not to <br />obstruct the flow of water. The State will be responsible <br />for maintaining paved drainage structures. <br /> <br />Various future State projects may be implemented which will <br />require removal and/or modification to all or a portion of <br />Permittee's landscaping. Upon completion of work which <br />affects the limits of maintenance, a revised Exhibit will be <br />prepared and will supercede the original limits shown on the <br />original permit plans. <br /> <br />-1- <br /> <br /> <br />
