REL:mb(7) Recording Requested by and when Recorded Mail to: Clerk of the Council City of Santa Ana 20 Civic Center Plaza Santa Ana, CA 92701 RECORDED; BOOK/PAGE DEED NO, TIME: RESOLUTION NO. 88-~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA SUMMARILY VACATING EXCESS RIGHT-OF-WAY LOCATED ON RITCHEY STREET WHEREAS, this Council finds and determines that a certain portion of Ritchey Street, more particularly described in Exhibit A, attached hereto and incorporated herein, is excess right-of-way street portion which is not required for street purposes for the following reason: (a) Said street portion was dedicated for right-of-way purposes by Deed recorded in Book 5049, pages 32 and 33 of Records of Orange County as a portion of an 84-foot wide street. (b) Said street has now been determined to require no more than 60 feet of width. WHEREAS, pursuant to the provisions of ~ 2381 of the Streets and Highways Code of the State of California, this Council does find and determine that the abovesaid street portion is not useful as a nonmotorized transportation facility, as defined in ~ 156 of said Code; and WHEREAS, this Council finds and determines that there are no in-place public utility facilities in the abovesaid street portion; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Pursuant to the provisions of Chapter 4 of Part 33 of Division 9 of the Streets and Highways Code of the State of California, and, in particular, Section 8334 thereof, that portion of Ritchey Street in the City of Santa Ana, County of Orange, State of California, specifically described in Exhibit A, attached hereto and incorporated herein by reference, is, under the facts hereinabove recited, hereby vacated, and from the date this
