330 <br /> <br />RESOLUTION NO. 88-49 <br />PAGE TWO <br /> <br /> 2. In accordance with SAMC section 34-191, the <br />purpose of the drainage area fee is to provide for drainage <br />facilities required to meet the drainage needs created by <br />subdivision or other development of properties within local <br />drainage areas which increase storm water runoff by coverage <br />of absorption areas and increase demand for protection from <br />storm waters. <br /> <br /> 3. In accordance with SAMC section 34-192, the use <br />to which the abovesaid fee will be put is the construction, or <br />reimbursement for construction, of drainage facilities within <br />the local drainage area from which the fee was collected. The <br />public facilities to be financed by the fee are identified in <br />Exhibit A, attached hereto and incorporated herein. <br /> <br /> 4. The fee applies to all types of development pro- <br />jects, including residential, commercial, office, and industrial, <br />which will increase storm water runoff by coverage of absorption <br />areas and increase demand for protection from storm waters. The <br />use of the fee for drainage facilities and the need for such <br />facilities is reasonably related to all types of development pro- <br />jects which have such effects because all such development pro- <br />jects generate storm water run-off or receive the benefit of <br />protection from storm waters provided by such facilities. The <br />restriction of the use of fees to drainage facilities which are <br />within the local drainage areas from which the fees are derived <br />assures that the fees derived from any given development project <br />are used to provide those drainage improvements which most dir- <br />ectly address the needs created by such development project. <br /> <br /> 5. As used hereinafter "project" means proposed <br />construction activity which is subject to the payment of a <br />drainage area fee under SAMC sections 34-191 through 34-195 and <br />as to which construction pursuant to a validly issued building <br />permit has not commenced as of the date of adoption of this <br />resolution. <br /> <br /> 6. Ail previous resolutions of the City Council <br />establishing or increasing drainage area fees are superseded by <br />this resolution, and the fees established by this resolution <br />shall apply to all projects, except as otherwise hereinafter <br />provided. <br /> <br /> 7. Any project for which a building permit has <br />been issued prior to the adoption of this resolution shall be <br /> <br /> <br />
